How to resign with immediate effect

Sometimes you need to leave a job right now — not in a month. Whether due to health, a toxic environment or a personal emergency, resigning with immediate effect is possible in some circumstances. Here's what you need to know.

Can you legally resign with immediate effect?

Technically, yes — but there are consequences. When you resign without working your notice period, you are in breach of contract. Your employer may be entitled to claim damages equal to the cost of your early departure (e.g. hiring agency fees for emergency cover). In practice, most employers don't pursue this for junior or mid-level roles, but it's a real risk for senior or specialist positions.

When immediate resignation is more justified

There are situations where courts and tribunals recognise that working notice was not reasonable:

• Constructive dismissal: Your employer has fundamentally breached your contract (e.g. stopped paying you, seriously bullied you, made your role untenable)
• Serious health risk: Continuing to work poses a genuine risk to your physical or mental health
• Personal emergency: A family crisis that makes immediate departure unavoidable

In constructive dismissal cases, resigning with immediate effect and then making a tribunal claim is the standard legal route — but get advice from ACAS or a solicitor before doing this.

Pay in lieu of notice (PILON)

If your contract includes a PILON clause, your employer can choose to pay you your notice period salary and release you immediately. This is the cleanest exit — you leave now, they pay you for the notice period. If your contract doesn't have PILON, they can still offer it by agreement, but they don't have to.
